Outcome: Motorcycle Driver killed.

Richard Rowe, 58, from Fort Worth, Texas died July 18, 2011 from a July 2, 2011 single motorcycle accident.  Rowe was speeding, lost control of his motorcycle, and hit a parked car.  He was wearing a helmet but died from blunt force head trauma at a local hospital.

In 2009, there were 4371 serious injury causing vehicle accidents in Fort Worth and Tarrant County, Texas. In this same year, 46 people were killed in wrongful death car accidents in Fort Worth & Tarrant County, Texas.  In the State of Texas, there were 3089 deaths from vehicle accidents and 59,164 serious personal injuries from vehicle accidents.   432 motorcyclists were killed in Texas in 2009, 60% of which were not wearing helmets.

Type: Hit and Run car accident and broken streetlights

Outcome: Passenger killed.

Non-working streetlights are a reason why a woman died in a hit and run accident in East Dallas.  Yolanda Guzman, 38, died at the hospital.  The driver of the vehicle, Rafael Valdovinos, suffered a broken hip and torn aorta.  Dallas PD says all electricity was out in the area at the time of the accident.  The pickup that hit Ms. Guzman and Mr. Valdovinos left the scene.  The pickup is gray with a black grille.

The accident happened at the intersection of Ferguson Road and Joaquin,  City of Dallas technicians were working on other non-working street lights at the time of accident.  Four other street lights were fixed before the City of Dallas fixed this street light, which was completed at 9:30 p.m.  A call to fix this light was sent by Dallas PD to City of Dallas at 5:50 p.m.

A hit and run accident injured a Richardson child who was driving his go-cart.  The accident happened at the intersection of Twilight Trail and Floyd Road in Richardson, Texas after 5p.m.  The child was driving the go-cart on the sidewalk when he was struck by an SUV who left the scene.

The child was taken to Children’s Medical Center Dallas, where he is in serious condition.  Richardson PD is investigating the case and is looking for leads to indentify the hit and run driver.   The SUV was driven by a woman with a white dog and might be black or dark blue.

Kaufman County ATV Four Wheeler Accident Kills Mother and Seriously Injures Her Child

Outcome: Mother/driver killed and passenger/son receives serious personal injuries

A mother driving an ATV four wheeler was killed and her son received serious personal injuries.  These people are from Greenville, Texas.  The mother’s name is Wendy Moore and her son was Daniel Peralez.  The accident happened on CR 141 in Kaufman County, Texas between 12:30 a.m. and 1:00 a.m.  At the intersection of CR 141 and Abner Road, between Kaufman and Terrell, the four wheeler could not control a turn and hit a tree.  A witness say the child asking for help and called 911 around 5:15 a.m.

The mother was ejected and died at the scene.  The son was airlifted to Parkland Memorial Hospital, where he is listed in stable condition.  Texas DPS could not explain why these people were driving the four wheeler on CR 141 overnight.

In 2008-09, there were 992 reported deaths from ATV accidents in the United States.  There were 267,000 emergency room treated injuries.  For children under age 16, there were 16 deaths in 2009 and 32,400 emergency room visits for injuries

To avoid four or three wheeler ATV accidents, it is recommended drivers get trained, everyone wears a helmet, no children should operate adult ATVs, there should not more than 1 person on an ATV, and there should be no riding on pavement or under influence of drugs or alcohol.

In Texas, there were 482 ATV deaths from 1982 to 2009, which included 131 deaths involving children under the age of 16.  In Texas all four wheeler ATV owners must apply for a title, register the ATV annually, and no passengers are allowed on ATVs on public lands unless the ATV is equipped to carry passengers.  Four wheeler ATV use on public streets is against the law unless the ATV is crossing the street for farming purposes.   All operators under 14 must be accompanied by an adult and no ATVs on public lands may be used 1/2 hour after sunset or 1/2 hour before sunrise unless that is tail and headlights in operation.

A driver was killed in a one car accident in the early morning on North Central Expressway @ Knox-Henderson.   Dallas PD said the driver was going fast, lost control and hit a tree.  The driver died at the scene and a passenger was taken to the hospital in critical condition.

In 2009, there were 161 wrongful death car accidents and 5721 serious injury causing car accidents in Dallas and Dallas County, Texas. In this same year, there were 59,164 serious personal injury crashes in Texas resulting in 80,360 people sustaining serious personal injuries and 3089 deaths.  There were no deathless days in Texas in 2009.   1127 were killed in single vehicle accidents, which is 40% of all deaths.

Outcome: Pedestrian killed.

Benancio Herrera, a 70 year old man, was died from being hit by a car on the 300 block of Riverside Drive.  Fort Worth EMS and Fire Department told Fort Worth PD that the injuries led them to believe a car had hit Mr. Herrera.  When Fort Worth police arrived, Mr. Herrera was inside an ambulance and was unreponsive from a broken arm and could not provide accident information.

A witness stated Mr. Herrera was visiting a friend about 6p.m. and left his friend’s house to go to a store across the street.   Mr. Herrera was taken to John Peter Smith hospital with a head injury and broken arm.  He was pronounced dead at 11:40 p.m.  The cause of death is blunt force head trauma caused by motor vehicle pedestrian accident.

Motor vehicle collision Outcome:  Two people received serious bodily and personal injuries in a one car accident on Henry S. Grace Freeway in Wichita Falls, Texas.  A witness stated a small white car left the highway and struck a guardrail.   One of the personal injury victims was removed from the car by the jaws of life.   There was one adult and one child in the car.  All occupants were taken to the hospital in critical condition.

In 2009, there were 260 serious injury causing car accidents in Wichita Falls and Wichita County, Texas.  There were 59,164 serious personal injury crashes in Texas resulting in 80,360 people sustaining serious personal injuries.  Single vehicle, run off the road crashes resulted in 1227 deaths.  1 person was injured every 2 minutes 14 seconds in Texas and a crash was reported every 74 seconds.  There were 137.71 urban traffic crashes per 100 million vehicle miles on freeways such as US 287 in Wichita Falls, Texas.

Dallas PD To Start Enforcing Jaywalking Violations

Starting today, Dallas PD will start issuing traffic citations for individuals that are caught jaywalking.  Dallas PD has stated there has been in an increase in potentially dangerous pedestrian-car accidents over the city, including the area around the Frank Crowley Criminal Courthouse.

Any pedestrians caught crossing streets outside of the designated crosswalks may be issued a traffic ticket for this violation.   If issued a citation, you must respond to the Court within 21 days or the ticket turns into an alias warrant.  Dallas traffic ticket lawyers are able to lift alias warrants and obtain court dates.  If the Dallas police officer that issued the traffic ticket does not show up to Court, the traffic ticket may get dismissed.

Pedestrians that walk outside of crosswalks subject themselves to potentially dangerous personal injuries and sometimes death.   In 2007 in the U.S., there were 70,000 pedestrians were injured and 4654 were killed by cars and other automobiles.  In Texas in 2007, 387 pedestrians were killed.  73% of these death accidents occurred in downtowns and 64% of the pedestrian auto accident deaths occurred at night.

To avoid pedestrian accidents, one should always be aware of surroundings, try not to walk at night, or if you must walk at night, wear reflective clothing and carry a flashlight.  Never assume cars or other vehicles can see you or the car will stop to let you cross.  Always walk on sidewalks if they are available.  Never walk if intoxicated.

Gov. Perry Refuses To Sign Law To Ban Texting & Driving

Texas Governor Rick Perry vetoed a bill that would have prevented texting and driving.  His excuse is the bill is “an overeach and it was a government effort to micro manage the behavior of adults.”

The bill, had it been signed by Gov. Perry, would have been known as the Alex Brown Memorial Act.  Alex Brown was teenager who died in a single car accident because she was texting.  The bill would have required Texas cities and counties to prohibit a person from sending or receiving a text message while driving a car.  

Text-based messaging is prohibited in 31 states.  Texas decided not to join this group.  Nine states prohibit texting and driving by new drivers and three states prohibit school bus drivers from texting.  Eighty percent of all car accidents result from driver inattention.  Some studies show drivers that text and drive are twenty more times likely to have an auto accident than drivers that are talking on a cell phone.  Drivers who text take their eyes off the road an average of 4.6 seconds for every 6 seconds they are driving.

In 2009, 5474 were killed in car accidents in the U.S. because of distracted driving and 448,000 were injured.  Of the 5474 car accident deaths, 995 involved cell phones.

Gov. Perry Signs Bill To Increase Punishment for Drunk Drivers

House bill 1199 has been signed by Gov. Perry.    This law is known as the Abdallah Khader Act.  Abdallah Khader is a five year old boy that has permanent brain damage because he was injured by an intoxicated drunk driver.  The Defendant Stewart Richardson, was a repeat drunk driver, who crashed into the Khader family car.   Abadallah’s mother has stated “Every single day it breaks my heart.”

This law will increase penalities for drunk driving offenses.  The law is effective September 1, 2011.  Unfortunately, it will not apply to Abdallah Khader’s case.  The new law states a drunk intoxicated driver will be found guilty of a second degree felony if, at trial, it is shown the drunk driving caused “serious bodily injury to another in the nature of a traumatic brain injury that results in a persisent vegetative state.”

The law also states that if an alcohol concentration level of 0.15 or more is found, the offense is a Class A misdemeanor.  Unfortunately, other laws to prevent drunk driving were not signed by Governor Perry, including laws to revoke drunk driver’s licenses after second offenses; laws to implement sobriety checkpoints, and mandatory interlock devices for first time offenders.

Last year, Texas ranked 45 out of 50 states with the worst drunk driving incidents.  There were 1235 deaths from drunk drivers; 124,662 arrests of 3 time repeat offenders; 18,271 arrests of 5 time repeat offenders.  Forty percent of traffic deaths were from drunk drivers.

MADD supports setting the illegal blood alcohol content (BAC) limit for non-commercial drivers age 21 and older at .08.   This is the law in Texas.
