A person killed in an accident can file a lawsuit to recover past medical bills; lost wages, future lost wages, and burial expenses. Some relatives may recover compensation for emotional distress.  In single car accident cases, sometimes there can be a defective products liability case against the car manufacturer, even if there is some driver error.  One must show the car was defectively designed or manufactured or there were no warnings of a potential rollover.

For most personal injury accidents, lawsuits must be brought two years from the date of accident or the claim is barred.
