Thirteen Year Old Passenger Dies in 18 Wheeler Fort Worth Accident

Friday, August 5th, 2011

Date: August 4 , 2011, 08-04-2011

Location: I-30, Fort Worth, Tarrant County, Texas

Type: 18 wheeler tractor trailer truck accident,  guardrail head on collision

Outcome: One killed; Driver injured

A thirteen (13) year old boy from McKinney, Texas was killed in a 18 wheeler accident in Fort Worth, Texas. The teenager’s father was driving the 18 wheeler tractor trailer truck.   The teenager’s name is Hector Hernandez and was asleep in the sleeper portion of the truck and died at the accident scene.   The driver was eastbound at 7400 I-30 and for unknown reasons allowed the 18 wheeler truck to drift to the right, hit a guard rail and smash into a bridge support.  This portion of I-30 is closed until Friday night due to road construction repairs from the accident.

We see two potential causes of this accident.  It is possible the driver had fatigue and the child was not in a child booster seat or using a seat-belt.

Federal Motor Carrier Safety Act (FMCSA)  rules forbid driving an 18 wheeler tractor-trailer truck more than 11 hours or to drive after having been on-duty for 14 hours. The 3-hour difference allows drivers to take care of non-driving working duties such as loading and unloading cargo.    After completing a 11- to 14-hour on-duty period, the driver must be allowed 10 hours off-duty.

Once children outgrow their booster seat (usually at 4′9″, 100 pounds) they can use the adult safety belt if it fits them properly.
Lap portion low over the hips/tops of thighs and shoulder belt crosses the center of the shoulder and center of the chest.

Although the deceased is a child of the driver, he still may pursue a negligent driving claim against his father, his employer, or owner/operator of the tractor-trailer.
